International Commercial Arbitration Fees

1.1. REGISTRATION FEES

a) Claimant shall pay a nonrefundable fee of $500.

b) For emergency application, applicant shall pay a nonrefundable fee of $500.

c) Registration fees shall be applicable to claim as well as counter claim.

1.2. ADMINISTRATION FEES

The Centre shall determine the administration fees of the Centre for the international commercial arbitration on the basis of the amount in dispute as specified in the following schedule;

1.3. ARBITRATORS FEES

For international commercial arbitrations conducted pursuant to and administered under these Rules, the fee calculated in accordance with the Schedule below is the maximum amount payable to each arbitrator, unless the parties have agreed to an alternative method of determining the Tribunal’s fees pursuant to Rules 61.2. and 61.3.

  1. In case the Arbitral Tribunal is a Sole Arbitrator, she/he will be entitled to an additional 20% of the above Fee schedule

  2. In case of Expedited Arbitration, fee shall be 80% of above fee schedule

  3. Presiding arbitrator shall get 10% more than co-arbitrators from total fees in the schedule.

  4. For disputes which cannot be quantified, the fee will be finalized by Centre based on the facts

1.4. EMERGENCY ARBITRATION FEES

For emergency arbitrations conducted pursuant to and administered under these Rules, the fee calculated in accordance with the Schedule below is the maximum amount payable to each arbitration;

1.5. Travel expenses

If any Bhutanese or non-Bhutanese arbitrator is required to travel for the purpose of Centre’s arbitration out of arbitrator’s country/state, an arbitrator will be reimbursed for the actual travel expenses he or she incurs travelling from and returning to his or her usual place of business as indicated on the curriculum vitae filed for the relevant Centre’s arbitration. Travel expenses will be reimbursed as under:

a) Air travel: an airfare equivalent to the applicable standard business-class airfare.

b) Transport to and from airport(s): the actual taxi fare.

c) Food and Lodging: actuals up to 4-star hotel
